In accordance with the obligations under Law 34/2002, of services of the Information Society and electronic commerce (hereinafter LSSIYCE), THE TRAIL ZONE SL, with CIF B-66625757, and address at Carretera BV- 2112 Km 4.5 (Sota Ribes) , 08810 Sant Pere de Ribes (Barcelona), states that the mobile application Open Trail Races is owned by them. THE TRAIL ZONE SL is registered in the Mercantile Registry of Barcelona, in volume 45040, folio 46, sheet number 475154, inscription 1.
THE TRAIL ZONE SL cannot assume any responsibility derived from the incorrect, inappropriate or illicit use of the information appeared in its application. Within the limits established by law, THE TRAIL ZONE SL assumes no liability for lack of access, incorrect display, errors in downloading files, lack of veracity, completeness, updating and accuracy of the data or information contained in its application.
The contents and information of the application of THE TRAIL ZONE SL are prepared by professionals duly qualified for the exercise of their profession. However, the contents and information do not bind the aforementioned, nor do they constitute opinions, advice or legal advice of any kind, as it is merely a service offered for informational and informative purposes. USER REGISTRATION
Any person who wishes to do so and who is over 18 years of age with sufficient capacity to act can create their own account by entering all the data requested in the “user registration” section. By registering as a User, you agree to respect all the conditions set out above, and if you do not agree with any of them, you should not register as a user on this website. Therefore, the acceptance of these conditions implies the acceptance by the user of all of them expressly and in their entirety. The user with the completion of their data declares that all data provided are true, updated and correspond to his person. Once the procedure has been completed, the user will be able to access his/her personal area, where he/she will be able to view his/her history of participation in events, the messages received, as well as his/her personal data. At any time the USER will be able to make the modifications that he/she considers convenient, as well as to cancel the account. In order to authenticate in this APP, the USER will have a username and password that will be chosen by the USER and that will allow him/her to access a personal area. The password must be personal, secret and non-transferable, not being allowed or recommended the transfer, even temporarily, to third parties. Therefore, the user undertakes to use it diligently and to keep it secret, assuming all responsibility for the consequences of its disclosure to third parties by allowing or not taking the necessary care to prevent third parties from becoming aware of it. In the event that the user knows or suspects the use of your password by third parties, you must change it immediately in your personal area of the web or immediately notify THE TRAIL ZONE SL, to proceed to its modification.
LOCATION
The location data is used in order to direct you to the start point of the selected race, to guide you during the activity in following the race track (navigation), as well as to record the track you have run and to be able to compare it with the official race track. When you search for races in the app, we receive the location from the map center to allow us to display races near your location or in the area selected by you. Your device requests your consent before Open Trail Races uses location for the first time, and you can withdraw that consent at any time through the Device Settings app.
PROTECTION OF PERSONAL DATA
Under Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that your personal data, which you have provided in the registration form, as well as data relating to your participation in the sporting events promoted by this application, are incorporated into a file under the responsibility of the company THE TRAIL ZONE SL, CIF: B-66625757. The purpose of this file is to be able to register and properly inform you of the races contained in the APP, as well as to inform you of improvements in the APP, events and promotions related to them.
These data may be transmitted to third parties or companies organizing the races that are promoted in this application. The classifications in the races will be public domain and you expressly agree that your name, surname, age group (category) and sex, will be published in the same, both on the website opentrailraces.com, as in the section of classifications of the APP, as on the page of the organizer of the race.
THE TRAIL ZONE SL can not be held responsible in any case for the use that third parties may make of the data contained in these classifications.
ASM Web Services SL, hereinafter ASM, is the entity in charge of carrying out the management and technical maintenance of the APP Open Trail Races. In the execution of the aforementioned functions, this company will be the only one that will have access to the data entered by you, which will be treated with absolute confidentiality. ASM has adopted the necessary technical measures in order to avoid, as far as possible, the alteration, loss, treatment or unauthorized access by third parties to the data entered by you.
In order for the online management system to adapt to your needs, cookies are available. Cookies are used to track your passage through the web and are used exclusively to improve the personalized system of each user. They are neither invasive nor harmful and do not contain confidential data. THE TRAIL ZONE SL has a file hosted in Spain in accordance with the LOPD, to which only have access ASM staff as responsible for the technological management of the APP and the staff of THE TRAIL ZONE SL or group companies. INDUSTRIAL AND INTELLECTUAL PROPERTY
This APP Open Trail Races is property of THE TRAIL ZONE SL. The Intellectual Property rights and rights of exploitation and reproduction of this APP, its pages, screens, the information they contain, their appearance and design, as well as the links (“hyperlinks”) that are established from it to other web pages of any subsidiary and/or dominated company of THE TRAIL ZONE SL, are the exclusive property of the latter, unless expressly specified otherwise. Any denomination, design and/or logo, as well as any product or service offered and reflected in this APP, are trademarks duly registered by THE TRAIL ZONE SL, by its subsidiaries and/or dominated companies or by third parties. Any improper use of the same by persons other than their legitimate owner and without the express and unequivocal consent of the latter may be denounced and prosecuted through all legal means existing in the Spanish and/or Community Legal System. The intellectual property rights and trademarks of third parties are conveniently highlighted and must be respected by anyone who accesses this page, not being the responsibility of THE TRAIL ZONE SL the use that you THE USER can carry out in this regard, falling the sole responsibility on his person. Only for personal use is allowed to download the contents, copy or print any content of this APP. It is forbidden to reproduce, transmit, modify or delete the information, content or warnings of this APP without the prior written permission of THE TRAIL ZONE SL. THE TRAIL ZONE SL does not transfer ownership of its software to users.
THE TRAIL ZONE SL owns all industrial and intellectual property rights, including the software. If the user transfers the software of this APP to your terminal, you may not dissect for study and decompile, translate the version of the original object code or language to another code or language.
APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law, and the Courts and Tribunals of Barcelona are competent to hear any questions that may arise regarding the interpretation, application and compliance with them. You, THE USER, by virtue of your acceptance of the general conditions contained in this legal notice, expressly waive any jurisdiction that, by application of the Civil Procedure Law in force, may correspond to you.
