LEGAL INFORMATION (SPANISH LSSICE LAW)
In accordance with the obligations set out in Spanish Law 34/2002 on information society services and electronic commerce (hereinafter LSSICE), THE TRAIL ZONE SL, with tax ID (CIF) B-66625757 and registered address at Carretera BV-2112, km 4.5 (Sota Ribes), 08810 Sant Pere de Ribes (Barcelona), states that the Open Trail Races mobile application is its property. THE TRAIL ZONE SL is registered in the Barcelona Commercial Register, volume 45040, folio 46, sheet number 475154, entry 1.
THE TRAIL ZONE SL cannot accept any liability arising from the incorrect, inappropriate or unlawful use of the information appearing in its application. Within the limits established by law, THE TRAIL ZONE SL accepts no liability arising from lack of access, incorrect display, errors when downloading files, or lack of truthfulness, completeness, updating or accuracy of the data or information contained in its application.
The content and information in the THE TRAIL ZONE SL application are prepared by professionals duly qualified to practise their profession. However, the content and information do not bind the company, nor do they constitute opinions, advice or legal counsel of any kind, as this is merely a service offered for information and outreach purposes. The APP may contain links to third-party pages. THE TRAIL ZONE SL therefore cannot accept responsibility for content that may appear on third-party pages. The texts, images, sounds, animations, software and other content included in this application are the exclusive property of THE TRAIL ZONE SL or its licensors. Any act of transmission, distribution, assignment, reproduction, storage or public communication, in whole or in part, requires the express consent of THE TRAIL ZONE SL.
USER REGISTRATION
Anyone who wishes to do so and who is over 18 years of age with sufficient legal capacity may create their own account by entering all the details requested in the “user registration” section. By registering as a User, you undertake to respect all the conditions set out, and if you do not agree with any of them, you must not register as a user. Accordingly, acceptance of these conditions means that the user accepts all of them expressly and in full. By filling in their details, the user declares that all the information provided is true, up to date and their own. Once the procedure is complete, the user will be able to access their personal area, where they can view their history of participation in events, the messages received and their personal data. The USER may make any changes they consider appropriate at any time, as well as close the account. To log in to this APP, the user will have a username and password chosen by themselves, giving access to a personal area. The password must be personal, secret and non-transferable; passing it on to third parties, even temporarily, is neither permitted nor recommended. The user therefore undertakes to use it diligently and keep it secret, accepting full responsibility for the consequences of disclosing it to third parties or of not taking the necessary care to prevent others from learning it. If the user knows or suspects that their password is being used by third parties, they must change it immediately in their personal area or notify THE TRAIL ZONE SL immediately so that it can be changed.
LOCATION
Geolocation data is used to direct you to the start point of the selected race, to guide you along the race route during the activity (navigation), and to record the route you have completed so it can be compared with the official race route.
When you search for races in the app, we receive the location of the centre of the map so that we can show you races near your location or in the area you have selected.
Your device asks for your consent before Open Trail Races uses your location for the first time, and you can withdraw that consent at any time in your device settings.
PERSONAL DATA PROTECTION
Under Spanish Organic Law 15/1999 of 13 December on the Protection of Personal Data, we inform you that the personal data you have provided in the registration form, together with the data relating to your participation in the sporting events promoted by this application, are included in a file for which the company THE TRAIL ZONE SL, CIF B-66625757, is responsible. The purpose of this file is to register you and keep you properly informed about the races in the APP, as well as to inform you about improvements to the APP and related events and promotions.
This data may be passed on to third parties or to the companies organising the races promoted in this application. Race rankings will be public, and you expressly accept that your first name, surname, age group (category) and sex will be published in them, on the opentrailraces.com website, in the rankings section of the APP and on the race organizer's page.
THE TRAIL ZONE SL can in no case be held responsible for any use that third parties may make of the data contained in these rankings.
ASM Web Services SL, hereinafter ASM, is the entity responsible for the management and technical maintenance of the Open Trail Races APP. In carrying out these functions, this company will be the only one with access to the data you enter, which will be treated in the strictest confidence. ASM has adopted the necessary technical measures to prevent, as far as possible, the alteration, loss, processing or unauthorised access by third parties of the data you enter.
So that the online management system can adapt to your needs, it uses cookies. Cookies record your visit to the website and are used exclusively to improve each user's personalised system. They are neither invasive nor harmful, and do not contain confidential data. THE TRAIL ZONE SL has a file hosted in Spain in accordance with data protection law, to which only ASM staff, as those responsible for the technological management of the APP, and the staff of THE TRAIL ZONE SL or group companies have access. INDUSTRIAL AND INTELLECTUAL PROPERTY
The Open Trail Races APP is the property of THE TRAIL ZONE SL. The intellectual property rights and the rights of exploitation and reproduction of this APP, its pages, screens, the information they contain, their appearance and design, as well as the links (“hyperlinks”) established from it to other websites of any subsidiary and/or controlled company of THE TRAIL ZONE SL, are its exclusive property, unless expressly stated otherwise. Any name, design and/or logo, as well as any product or service offered and shown in this APP, are trademarks duly registered by THE TRAIL ZONE SL, its subsidiaries and/or controlled companies, or by third parties. Any improper use of them by persons other than their legitimate owner and without their express and unequivocal consent may be reported and prosecuted through all the legal means available under Spanish and/or EU law. Third-party intellectual property rights and trademarks are duly highlighted and must be respected by anyone accessing this page; THE TRAIL ZONE SL is not responsible for any use that you, THE USER, may make of them, the responsibility lying exclusively with you. Downloading, copying or printing any content of this APP is permitted for personal use only. Reproducing, transmitting, modifying or deleting the information, content or notices of this APP without the prior written authorisation of THE TRAIL ZONE SL is prohibited. THE TRAIL ZONE SL does not transfer ownership of its software to users.
THE TRAIL ZONE SL holds all industrial and intellectual property rights, including the software. If the user transfers the software of this APP to their device, they may not dissect it for study, decompile it, or translate the original object code version or its language into another code or language.
APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law, and the Courts of Barcelona shall have jurisdiction over any matters arising from their interpretation, application and fulfilment. You, THE USER, by accepting the general conditions set out in this legal notice, expressly waive any other jurisdiction that might correspond to you under the Spanish Civil Procedure Act in force.
